त्यस्तै सोही धारामा उल्लेख छ कि , ” जसले “संक्रामक रोग फैलाउने” लापरवाही गर्दछ, उसलाई ३ बर्षको जेल सजाय जरिवाना हुनेछ।
The law is clear. Article 283 of the Penal Code provides for up to five years in prison for punishment for anyone who creates a danger of “spreading contagious disease”. Anyone who does so carelessly risks a penalty of three years.
The mentioned CP point establishes the punishment for “disease spread, alteration of analysis or prescription”. However, it is not the only sanctioning regime in existence for anyone who disrespects confinement.
According to diploma 81/2009 of the Law on the Public Health Surveillance System, individuals who do not comply with the orders of the health authorities risk violations between 100 euros and 10,000 euros, while companies are liable to pay between 10 thousand and 25 thousand euros.
Confinement is provided for in the Basic Law on Health. According to base 34, “the health authority is responsible for the decision of the State to intervene in the defense of public health, in situations that may cause or accentuate serious damage to the health of citizens or communities, and health surveillance at the national territorial level that derives from the circulation of people and goods in international traffic “.
Such an authority may “trigger, in accordance with the Constitution and the law, internment or compulsory provision of health care to persons who would otherwise be a danger to public health”, as well as order the “closure of services, establishments and places for public and private use, when operating under conditions of risk to public health “.
